Disclaimer & Limitation of Liability

PLEASE READ THIS DISCLAIMER CAREFULLY. By using Trefnus CMMS, you acknowledge and agree to all terms set forth below. This disclaimer supplements and forms part of the Terms of Service.
1. General Disclaimer
Trefnus CMMS (the "Application") is a computerised maintenance management tool designed to assist users in organising and tracking maintenance activities. The Application is provided strictly as an informational and organisational aid.
The Application does not provide professional engineering advice, safety assessments, regulatory compliance guidance, or any form of professional consultation.
2. No Professional Advice
Nothing in the Application constitutes:
- Professional engineering, mechanical, electrical, or safety advice;
- Certified maintenance planning or scheduling;
- Regulatory or legal compliance advice;
- Health and safety assessments or risk evaluations;
- Insurance, financial, or legal advice;
- A substitute for qualified professional inspection, assessment, or certification.
Users should always consult qualified professionals for maintenance decisions, safety-critical tasks, and regulatory compliance matters.
3. No Guarantee of Accuracy
The Application relies entirely on data entered by users. We make no representations or warranties regarding:
- The accuracy, completeness, or reliability of any data stored in the Application;
- The correctness of any maintenance schedules, intervals, or reminders;
- The suitability of any maintenance procedures or checklists;
- The accuracy of any reports generated by the Application.
All data output is only as accurate as the data input. "Garbage in, garbage out" applies fully.
4. Safety-Critical Disclaimer
CRITICAL SAFETY WARNING: The Application is NOT designed, intended, or certified for use in safety-critical applications. This includes but is not limited to:
- Life-safety systems (fire suppression, emergency systems, medical equipment);
- Safety-critical infrastructure (bridges, tunnels, structural components);
- Nuclear, aviation, or maritime safety systems;
- Pressure vessels, lifting equipment, or safety-critical mechanical systems;
- Any application where failure to perform maintenance could result in death, personal injury, or significant property damage.
YOU MUST NOT rely solely on this Application for safety-critical maintenance scheduling or tracking. Independent safety management systems, qualified personnel, and regulatory frameworks must always be used.
5. Statutory and Regulatory Compliance
The Application may include features for tracking statutory testing and regulatory compliance dates. However:
- The Application does not guarantee compliance with any law, regulation, standard, or code of practice;
- Compliance reminders are based solely on user-entered data and may be incomplete or incorrect;
- Users are solely responsible for ensuring compliance with all applicable regulations;
- The Application does not replace mandatory inspection regimes, statutory examination schemes, or certified compliance programmes;
- Failure of the Application to send reminders or alerts does not relieve you of any regulatory obligations.
6. Data Loss and Integrity
The Application stores all maintenance data locally on your device. We do not provide cloud storage, automatic backups, data synchronisation, or data recovery services. Data may be lost due to:
- Clearing browser data or cache;
- Uninstalling the Application or removing it from your device;
- Device failure, theft, or loss;
- Browser updates or changes;
- Operating system updates or reinstallation;
- Corruption of browser storage;
- Any other cause beyond our control.
YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING ADEQUATE BACKUPS OF ALL DATA. WE SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY DATA LOSS.
7. Equipment and Asset Disclaimer
The Application may be used to track maintenance of equipment, machinery, and assets. We expressly disclaim any responsibility for:
- Equipment failure, breakdown, or malfunction;
- Damage to property arising from maintenance performed or not performed;
- Personal injury resulting from equipment use, maintenance, or failure;
- Loss of production, downtime, or business interruption;
- Any consequences arising from reliance on data stored in the Application;
- Incorrect or missed maintenance schedules;
- Costs of repair, replacement, or remediation.
8. Offline Functionality Disclaimer
The Application offers offline functionality through service worker technology. While offline:
- Licence verification cannot occur, and access is granted based on cached credentials;
- Some features may not function correctly;
- Data entered offline is stored locally and is not backed up;
- We cannot guarantee the reliability or completeness of offline functionality.
9. Third-Party Content and Services
The Application may use third-party services (including Supabase, CDN-hosted libraries). We do not control and are not responsible for:
- The availability or uptime of third-party services;
- Security breaches or data loss at third-party providers;
- Changes to third-party services that may affect the Application;
- Any content or services provided by third parties.
10. Limitation of Liability
Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS. WE WILL PROVIDE THE APPLICATION WITH REASONABLE CARE AND SKILL AS REQUIRED BY APPLICABLE LAW.
- TREFNUS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APPLICATION.
- THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, BUSINESS OPPORTUNITIES, EQUIPMENT DAMAGE, OR ANY OTHER LOSSES. THIS INCLUDES PERSONAL INJURY OR PROPERTY DAMAGE, EXCEPT WHERE CAUSED BY OUR NEGLIGENCE.
- OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE APPLICATION SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) £100.
- SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Assumption of Risk
By using the Application, you expressly acknowledge and agree that:
- You use the Application entirely at your own risk;
- You are solely responsible for all maintenance decisions, actions, and omissions;
- You do not rely on the Application as the sole basis for any maintenance, operational, safety, or business decision;
- You will maintain independent records and backup systems;
- You understand the limitations of locally stored data;
- You accept full responsibility for any consequences arising from your use of the Application.
12. Insurance Disclaimer
The Application is not an insurance product and does not provide any form of coverage or indemnity. Use of the Application does not satisfy any insurance requirements. Users should maintain appropriate insurance coverage for their equipment, assets, and business operations independently of the Application.
13. No Endorsement
The inclusion of any feature, category, or option in the Application does not constitute an endorsement or recommendation of any particular maintenance practice, product, service, or provider.
14. Governing Law
This Disclaimer is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
